BACKGROUND:
Pursuant to NRS 237.080 and 237.090, a BIS was prepared for the proposed ordinance amending the rentals, fees, and charges at Henderson Executive Airport, North Las Vegas Airport, Jean Airport, and Overton Municipal Airport (collectively, the General Aviation Airports).
On May 21, 2025, the Clark County Department of Aviation (DOA) sent notification of the proposed rate changes to approximately 419 companies and individuals. In addition, public notice was published in the Las Vegas Review-Journal on May 23, 27, and 29, 2025. The notification and proposed ordinance were also posted on the Public Notices sections of the harryreidairport.com, hnd.aero, and vgt.aero websites.
A 15-day public comment period was provided, during which the DOA received three comments. These comments, submitted by based tenants, expressed concern that rates would increase immediately to the maximum amounts once the ordinance takes effect. However, these concerns are not material because the ordinance does not impose automatic rate increases. The DOA will implement any increases in incremental steps annually over multiple years. Additionally, none of the comments quantified an economic burden or indicated that the proposed changes would restrict the formation, operation or expansion of a business.
Staff recommends that the Board of County Commissioners accept and approve the BIS described above and determine that it does not impose a significant economic burden upon a business or directly restrict the formation, operation or expansion of a business.
