BACKGROUND:

UMC has had an agreement with Nevada Donor Network, Inc. (NDN) for organ and tissue procurement and associated transplant services since 1991.  This request is to enter into a new agreement with NDN to continue to serve as the organ and tissue procurement agency for UMC.  The term is from January 1, 2024 through December 31, 2025 unless terminated with a 30-day written notice.  After the initial term, the agreement will automatically renew for no more than three (3) one-year periods.

NDN and UMC will coordinate on the recovery, donation and associated transplantation of organs and tissue between donor and recipient.  UMC shall provide qualified and appropriately licensed surgical recovery teams, and ensure the medical suitability of donor organs for transplantation.  NDN shall oversee the arrangement and procedures for organ recovery (i.e. procurement, labeling, packaging and transportation).  UMC will reimburse NDN the approved Center for Medicare and Medicaid Services (CMS) Standard Acquisition Fee (SAC) at the time of the kidney transplant.  NDN, from time to time, will request changes to the SAC based on changes published by CMS.

UMC is an approved Transplant Hospital per Title 42 of the Code of Federal Regulations, together with the requirements of the United Network for Organ Sharing (UNOS).  UMC is mandated under these requirements to have an agreement with a federally designated Organ Procurement Organization (OPO), with a tissue and eye bank.  NDN is the federally designated organ, tissue and eye procurement organization in the State of Nevada.  This agreement is necessary to maintain compliance with CMS for conditions of participation of Transplant Hospitals, conditions of coverage for OPOs, and state law.

In accordance with NRS 332.115.1(a), this service is a sole source and the competitive bidding process is not required as there is no other provider of these services.

UMC’s Director of Transplant Services has reviewed the Agreement and recommends approval by the Board of Hospital Trustees. The Agreement has been approved as to form by UMC’s Office of General Counsel.

NDN currently holds a Clark County Business License.

This Agreement was reviewed by the UMC Governing Board at their January 31, 2024 meeting and recommended for approval by the Board of Hospital Trustees.
