BACKGROUND:

The Clark County Water Reclamation District (District) owns and operates the Whitney Lift Station located on Broadbent Boulevard, north of Russell Road.  The District completed the design for Project 19100 Whitney Lift Station Rehabilitation which includes a three (3) mile long, 20-inch force main from the Whitney Lift Station to the Flamingo Water Resource Center located at 5857 E. Flamingo Rd.  The proposed force main crosses Duck Creek near Broadbent Boulevard located on Assessor's Parcel Number 161-26-396-002 owned by Clark County.  The District requests an 8,812 square feet easement for constructing and maintaining sanitary sewer facilities at no cost to the County, as more particularly described in the attached Grant of Non-Exclusive Easement.

On March 7, 2023, the Clark County Department of Real Property Management presented an agenda item to the Board granting approval of a non-exclusive grant of easement for the Whitney Lift Station site and the 20-inch force main through the Wetlands Park, north of Duck Creek.  The District and the Clark County Public Works Department negotiated the terms of an easement for the Duck Creek crossing, which is presented for Board consideration.

Staff recommends the Board approve and authorize the respective Managers to sign the Non-Exclusive Grant of Easement for the Duck Creek crossing.

This agenda item has been reviewed and approved as to form by the District General Counsel and District Attorney’s Office.
