BACKGROUND:

Hai Dang is the owner of 6145 Misty Brook Ct., Las Vegas, Nevada. Mr. Dang initiated an administrative action against Clark County, challenging the service fees and administrative citations imposed against him for transient lodging violations. Mr. Dang paid the disputed amount ($17,175) to Clark County as a deposit before the administrative hearing. The administrative action was decided in Clark County's favor and Mr. Dang sought to file a petition for judicial review in District Court. Code Enforcement and Mr. Dang negotiated a settlement agreement before the filing of the petition. The settlement agreement includes the following terms: (1) Mr. Dang will allow Clark County to keep $8,587.50 (50% of the deposit), (2) Mr. Dang covenants to not engage in any transient lodging activity at any property in unincorporated Clark County without a license, (3) Mr. Dang will receive $8,587.50 from Clark County (50% of the deposit), and (4) Mr. Dang will not file a petition for judicial review.

The District Attorney's Office recommends that the Board of County Commissioners approve the settlement agreement and authorize the Chief of Code Enforcement to sign the settlement agreement on behalf of Clark County.
