BACKGROUND:

Clark County is expected to enter into numerous revocable license and maintenance agreements that will allow property owners to privately connect to the public sewer by a sewer force main connection. The improvements will be placed in the County right-of-way. To facilitate the processing of these agreements more efficiently and effectively by the Clark County Department of Public Works (CCPW), it is in the best interest of the Board of County Commissioners to delegate authority to the Director of Public Works or his designee to approve and execute these revocable license and maintenance agreements. Agreements will only be entered into upon approval of a land-use application, and submittal of a CCPW Offsite Improvement Permit or CCPW Encroachment Permit. Licensee will be required to pay an annual fee to the County to secure its obligations set forth in the agreement. The attached standard Revocable License and Maintenance Agreement for Sewer Force Main Connection has been created by CCPW and the District Attorney's Office.

The District Attorney's Office has reviewed and approved the agreement as to form.
