BACKGROUND:

The Stallion Mountain Community consists of thousands of homes and an 18-hole golf course on the northeast corner of Cabana Drive and E. Flamingo Road.  The Clark County Water Reclamation District (“District”) owns land along the community’s southern frontage on Flamingo Road. The community’s golf course was constructed in 1991.  In the years since, a residential community has been developed in the areas surrounding the golf course.  In 1998, the District entered into a License and Maintenance Agreement granting the Stallion Mountain County Club a revocable license for ingress and egress over a portion of the District’s land into the community.

The sale of the Stallion Mountain Golf Course to a new owner is currently in escrow, and the current owner has approached the District seeking consent to assign the License and Maintenance Agreement to the would-be new owner, SMGC Acquisition LLC.

Staff recommends that the Board approve an assignment of the License and Maintenance Agreement to the would-be new owner, SMGC Acquisition LLC.

This agenda item has been reviewed and approved by the District General Counsel.
