BACKGROUND:
CSR Water Cooperative ("CSR Water"), a Nevada nonprofit cooperation, was formed for the purpose of owning and maintaining the water facilities defined in the Declaration of Covenants, Conditions, and Restrictions ("Declaration") for The Ranch at Red Rock dated April 9, 2021. In August 2023, CSR Water submitted to Nevada Division of Environmental Protection ("NDEP") Bureau of Safe Drinking Water, its application and plan to permit a privately owned public water system. As a condition to the approval by NDEP, CSR Water must enter into this agreement with the local governing body. This agreement memorializes the responsibilities and obligations of CSR Water and the County as they relate to the water system permit and requirements under NRS 445A.895. The County’s sole and exclusive obligation with respect to the water system permit and water facilities is to use the surety furnished to the County required by NRS 445A.895(5) to pay the operator of the water system for the continued operation and maintenance of the system. The County shall have no repair, replacement or operation or maintenance obligations with respect to the water system and no obligation to provide water to water system customers.The District Attorney's Office has reviewed and approved the agreement as to form.
