BACKGROUND:

Senior County staff, the Clark County Fire Department, the District Attorney's office and the Department of Business License have been working with Mercy, Inc. on a new franchise agreement that will replace the existing franchise agreement that commenced on February 1, 2016. The new agreement is for a term of ten (10) years with an option to renew for five (5) additional years and it revises requirements for mutual aid requests; revises the calculation of credits to offset performance enhancement fees for good performance; modifies the penalty for not dispatching an ambulance timely; increases penalties for failure to meet the 90% response time requirement established in the Ambulance Service Ordinance; revises the calculation of franchise fees; provides for an exemption from increase in franchise fees if the franchisee exceeds certain performance levels; adds provisions that allow an audit of the franchisee's business records; and establishes an ambulance on scene policy

Staff recommends that the Franchise Agreement between Clark County and Mercy, Inc. d/b/a American Medical Response be approved.
