This Competitive Bidding Exception is for the purchase of Caterpillar equipment, parts, accessories, and supplies with Empire Southwest, LLC (NBE).

A Fiscal Directive No. 6, Competitive Bidding Exception, was approved because Empire Southwest, LLC is the authorized dealer of Caterpillar machines, equipment, engines, oil, and spare parts in the State of Nevada.

The following are the pertinent provisions of this approval:
•
The term of the approval is from date of award through June 30, 2029. A quote will be obtained for each                      purchase.
•
Clark County is not under exclusive contract with Empire Southwest, LLC and therefore, can cease                      purchasing product at any time.

The recommendation of award is in accordance with NRS 332.115.1(a), the competitive bidding process is not required as the item to be purchased is contracted from a sole source; (d), the competitive bidding process is not required as the equipment which, by reason of the training of the personnel or of an inventory of replacement parts maintained by the local government is compatible with existing equipment.

Empire Southwest, LLC currently holds a Clark County Business License.
