BACKGROUND: 

The property owner has requested Clark County to relinquish restrictive covenants, a Notice of Public Street Project Commencement (aka "No-Cut Notice"), off-site improvement agreements, a special improvement district covenant, and a pedestrian access agreement and covenant recorded against property owned by South 80 LLC generally referred to as "South Point." The encumbered parcel numbers are listed in the attached Relinquishment. The property owner states that the purpose of seeking the Relinquishment is to clear title to the properties. The Relinquishment has been reviewed and approved by the Department of Public Works which has determined that the restrictive covenants, agreements and other recorded encumbrances are no longer necessary.  

The District Attorney's Office recommends that the Board of County Commissioners approve and authorize the Chair to sign the Relinquishment.
