BACKGROUND:
On May 1, 2007, the Board of County Commissioners (Board) approved the award of CBE No. 600642-07 for Dark Fiber Lease Agreement to American Fiber Systems dba Idacomm, Inc. (NBE) in the amount of $752,000 to provide a lease for dark fiber. On May 20, 2011, Purchasing approved the assignment of Contract from American Fiber Systems dba Idacomm, Inc. to Zayo Group, LLC (NBE).
The following are the pertinent provisions of the Contract:
• The term of the Contract was from May 1, 2007, through April 30, 2012.
• Included the County’s option to terminate for cause, convenience or default and suspend the Contract with advanced written notice.
Amendment No. 1 extended the Contract term from May 1, 2007, through April 30, 2017, and included the option to renew for an additional 60-month period.
Amendment No. 2 extended the Contract term to June 20, 2017, and decreased the monthly cost beginning June 21, 2017, through June 20, 2022. It also included an additional one 60-month period beginning June 21, 2022, through June 20, 2027, with a 5% annual increase to the award amount.
Amendment No. 3 provided an additional 8 fibers for elections to create a redundancy path.
Approval of Amendment No. 4 will provide for a circuit expansion that is required to connect a new data center with the existing County networks. This will require an additional 32 fibers. The attached Amendment No. 4 document details the modifications and costs involved.
Zayo Group, LLC currently holds a Clark County Business License.
