BACKGROUND: 

Assessor's Parcel Numbers 125-20-803-014 and 125-20-803-016 were acquired to construct the Clark County 215 Bruce Woodbury Beltway; remnants of said parcels consisting of approximately 2.06 acres have been determined as surplus properties.

Plans to realign and widen Fort Apache Road between Blue Diamond Road and Warm Springs Road are in progress; to accommodate the improvements, it is necessary to acquire Assessor's Parcel Number 176-20-201-001 consisting of approximately 2.5 acres.

The owner of said parcel has proposed to exchange his property for the County's surplus properties identified as Assessor's Parcel Numbers 125-20-803-014 and 125-20-803-016, consisting of approximately 2.06 acres. The surplus properties are valued at $2,060,708, whereas, the value of the property the County will receive is $1,905,750. The property owner has agreed to convey his property to the County, together with $154,958 for the County's surplus properties. The owner is also releasing the County from all claims for severance damage, court costs, and interest that might be incurred if the County had to condemn the needed parcel. In addition to receiving the aforementioned sum, the exchange eliminates potential damage claims and litigation associated with acquisitions. Nevada Revised Statute 244.276 pertinent to widening, changing, and realigning roadways allows the County to proceed with the subject exchange.

The District Attorney's Office recommends acceptance of the proposed exchange and believes that it is in the best interest of the County.
