BACKGROUND: 

The claim is a result of a motor vehicle accident on November 10, 2023, whereby both drivers were traveling southbound Jones in the left lane.  The claimant was driving behind the County vehicle.  The County driver heard a request for assistance for traffic control over his radio.  The County driver activated the emergency lights and made a sudden U-turn to travel north on Jones.  The County driver did not use a turn signal during any turning movements.  The claimant claims that he did not have enough time to slow down and did not realize that the County driver was making a U-turn because the County driver initially moved to the right and did not use a turn signal.  The County vehicle struck the claimant’s vehicle.  The County driver was found at fault for the collision by LVMPD.  The medical treatment was at approximately $45,000.00, including anticipated future surgeries but not all potential future medical bills.

Through negotiations with legal counsel for the claimant, the claimant has agreed to accept $95,000.00 in settlement of the bodily injury claim to avoid any further costs and legal expenses of possible litigation in this case.  If the settlement is approved, the County would also avoid costs and expenses of any future litigation.

The proposed settlement has been reviewed and approved by the Civil Division of the District Attorney’s Office and the Clark County Liability Pool Committee members.
