BACKGROUND:
On May 4, 2004, Clark County (County) entered into a lease agreement with Opportunity Village for ±10.87 acres of unimproved land known as APN 163-34-201-013 (Main Building Premises) for the construction of the Opportunity Village Campus, which was amended on September 5, 2006, and again on December 20, 2006 (as amended, collectively the Main Building Lease).
On March 18, 2014, the County entered into a lease agreement with Opportunity Village for ±6.83 acres of unimproved vacant land now known as APN 163-34-201-029 (Leased Premises) for the construction of Betty’s Village which was amended on September 20, 2016, and again on May 7, 2019, (as amended, collectively the Betty’s Village Lease). The Main Building Lease & Betty’s Village Lease are collectively referred to as Leases.
Pursuant to the terms of the Leases, Opportunity Village is responsible for the payment of sewer fees. Due to the County's oversight and Opportunity Village’s limited reserves and non-profit funding model, they have requested to reimburse the County $184,590.38 to be considered full payment for outstanding sewer fees.
