BACKGROUND:
Pursuant to NRS 244.367, Clark County Code Title 13 Section 5609 regulates the sale, use, storage, and possession of fireworks in unincorporated Clark County. Senate Bill 4 of the 2021 Legislature amended NRS 244.367 authorizing the Board of County Commissioners to provide for the imposition of criminal or civil penalties for violations of Clark County's code regarding fireworks.
This ordinance amends Title 13.04.260 Section 5609.1.4 to impose civil penalties of $500 dollars (plus costs) for a first offense and $1,000 dollars (plus costs) for a second offense within three (3) years if the gross weight of the prohibited fireworks, including packaging, is less than 100 pounds. The ordinance also allows for a civil penalty of $5,000 dollars (plus costs) if the gross weight of the prohibited fireworks, including packaging, is more than 100 pounds but less than 5,000 pounds. If the gross weight of the prohibited fireworks is over 5,000 pounds, including packaging, the civil penalty is $10,000 dollars (plus costs). Civil penalties authorized by this ordinance shall not be imposed against a person who has been issued a license or permit under Title 13.04 nor can the civil penalties be imposed against a child under the age of eighteen (18) unless the child is emancipated.
Staff recommends that the ordinance to amend Chapter 13.04.260 of the County Code be introduced and a public hearing be set for February 15, 2022.
