BACKGROUND: 

On December 21, 2021, the Board of County Commissioners approved and adopted the "Second 10-Year Ozone Maintenance Plan for the 1997 Ozone NAAQS: Clark County, Nevada." The 2021 Second Ozone Maintenance Plan serves as the second 10-year maintenance plan for the Clark County 1997 ozone maintenance area and demonstrates how the area continues to attain the 1997 National Ambient Air Quality Standard (NAAQS) for ozone and will remain in attainment of the standard through 2033, satisfying the maintenance planning requirements of Section 175A of the Clean Air Act (CAA). The 2021 Second Ozone Maintenance Plan was forwarded to the U.S. Environmental Protection Agency (EPA), through the Nevada Division of Environmental Protection, for approval as a revision to the Nevada State Implementation Plan (SIP) on January 18, 2022.

The purpose of this SIP revision is to update the contingency plan contained in the 2021 Second Ozone Maintenance Plan to meet the requirements of CAA Section 175A(d). In a January 2023 meeting with Clark County representatives, EPA requested details on the timelines associated with some of the actions contained in the contingency plan. The attached proposed revision shows changes made to clarify the tracking and triggering mechanisms that will determine when contingency measures are needed and the actions resulting from trigger activation. Once approved, this plan will become federally enforceable and will serve as the contingency plan Clark County will use to assure prompt correction of any violation of the 1997 ozone NAAQS during the second maintenance period.

Staff recommends that the Board approve and adopt this SIP revision and authorize staff to submit it to the state of Nevada and EPA for approval as a revision to the Nevada SIP.
