BACKGROUND:
The District's treatment facilities utilize Turblex blowers in the water reclamation process to treat the odoriferous air that accompanies the wastewater received by the District. To ensure uninterrupted operation and maintain optimum performance, efficiency, and reliability, the District must have access to a readily available source of specialized parts, maintenance, and repair services.
Staff confirmed that Howden USA Company is the manufacturer and sole source distributor for Turblex blower specialized parts, and the only factory-authorized service center for maintenance, repair, and training services.
Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Howden USA Company for Turblex blower parts, maintenance, repair, and training services on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
The following are pertinent provisions of the agreement:
• The initial term of the agreement is from the date of award and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% each year of the contract term;
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.
In accordance with NRS 332.195.1(a), (c), & (d), the competitive bidding process is not required because parts, equipment, and services can only be purchased from a sole source distributor, and the replacement parts are compatible with the existing equipment which may be more efficiently added to, repaired, or maintained by a certain person. Howden USA Company (LBE) currently holds a Clark County business license.
