BACKGROUND:

This Competitive Bidding Exception is for the purchase of Smart Poles to be used in a current construction project with Valmont Industries, Inc. (Local Business Enterprise).

A Fiscal Directive No. 6, Competitive Bidding Exception, was approved because Valmont Industries, Inc. has a smart pole available that will meet the requirements of the current construction project without causing any delays of the project.

The following are the pertinent provisions of the contract, or this approval:

                     The term of the approval is for a one-time purchase.
                     Clark County is not under exclusive contract with Valmont Industries, Inc. and, therefore, can cease purchasing product at any time.

The recommendation of award is in accordance with Nevada Revised Statute 332.115.1(s); the competitive bidding process is not required as the item to be purchased is for the design of, and equipment and services associated with, systems of communication.
