BACKGROUND:
Nevada Revised Statutes 258.010 provides that the board of county commissioners in a county whose population is 700,000 or more may abolish the office of constable in one or more townships within the county if the board determines that the office is no longer necessary in that township or townships.
Chapter 2.15 of Title 2 of the Clark County Code was adopted in 2013 for the purpose of abolishing the elected Office of Constable for the Las Vegas Township, effective January 4, 2015.
The Board of County Commissioners is asked to determine whether the office of Constable for the Boulder City Township should be continued or whether, pursuant to NRS 258.010, the office be abolished because the office is no longer necessary in said township. In making such determination, the Board should consider whether there is an overlap of duties and functions between the Office of Constable for the Township and the Office of the Sheriff or any other private or public entity or combination thereof, that makes it unnecessary to maintain the Office of Constable for the Boulder City Township.
Staff recommends that the Board introduce the ordinance and set a public hearing for July 19, 2022, to consider the ordinance and if it is found that it is unnecessary to maintain the Office of Constable for the Boulder City Township to adopt said ordinance effective January 2, 2023.
