BACKGROUND:
This Agreement will provide a water commitment on a conditional basis only for a regional park special event area, located on the south side of Warm Springs Road, west of Fort Apache Road, on Clark County Assessor's Parcel Number 176-07-101-001. The following are the pertinent provisions of the Agreement:• The term of the Agreement will begin upon Las Vegas Valley Water District (DISTRICT) approval of the plans.• This Agreement shall terminate, and the conditional commitment shall be void if any of the following occurs:• Construction of the water facilities covered by the plan or plans identified in Article 1, paragraph D of this Agreement is not diligently commenced within one (1) year from the date of DISTRICT approval of said plan or plans; or• If active work is discontinued for a period of one (1) year, or if such construction is commenced within said one (1) year, but is not diligently prosecuted to completion in a manner acceptable to the DISTRICT.The recommendation of award is in accordance with NRS 277.180. The parties are authorized to enter into interlocal contracts to perform governmental functions and activities.
