BACKGROUND:
The District's West Campus Effluent Reuse Water (ERW) Pump Station and Temporary Storage Ponds utilize Floway vertical turbine pumps, and other various manufacturer authorized pumps, parts, and products. These pumps collect effluent reuse water for use throughout the District’s facilities as a flush/cooling water supplied to all pump seals to prevent cross contamination in the potable water distribution system. To ensure continuous plant treatment operations and maintain critical processes, the District must have a readily available source of pumps, replacement parts, and related products.
Staff confirmed that Phoenix Pumps, Inc. is the authorized sole source distributor of Floway and other various manufacturer authorized pumps, parts, and products.
The following are pertinent provisions of the agreement:
• The term of the agreement is from July 1, 2025, and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.
In accordance with NRS 332.115.1(a) & (d), the competitive bidding process is not required because the parts, equipment, and services can only be purchased from the authorized sole-source distributor, and the equipment is compatible with existing equipment. Phoenix Pumps, Inc. (LBE) currently holds a Clark County business license.
Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Phoenix Pumps, Inc. for the procurement of Floway and other various manufacturer authorized pumps, parts, and products on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
This agenda item has been reviewed and approved by the District General Counsel.
