Secure Rural Schools and Community Self Determination Act of 2000

BACKGROUND: 

On November 15, 2021, the United States Congress re-authorized the Secure Rural Schools and Community Self-Determination Act of 2000 for federal fiscal years 2021 through 2023.  The act is intended to help local governments offset property tax losses due to non-taxable Federal land within their boundaries.  Title I of this law provides funding for schools and roads in counties which contain national forests.  Title III law provides funding to reimburse counties for emergency services provided within national forests.  Of the funding provided, 85% is split, evenly, between roads and schools.  The remaining 15% is for reimbursement for emergency services.  The funding for schools is transmitted to the Clark County School District.  The funding for roads is deposited into the Road Fund (2020).  The funding for emergency services within national forests is deposited into the Mt. Charleston Fire District Fund (2900).


The federal law provides that a county’s election to receive payment must be transmitted by the Governor of each eligible state.  The State Treasurer's Office requires that the Board of County Commissioners approve and adopt a resolution electing to receive payment prior to the Governor transmitting the request to the federal government.
