BACKGROUND:
The District’s treatment facilities and various lift stations utilize KSB submersible mixers and pumps, which are distributed by DXP Enterprises, Inc. KSB mixers are used to provide essential mixing in the aeration basins, whereas KSB direct drive non-clog submersible wet pumps are used for handling liquid in wastewater treatment, particularly raw sewage, and activated and digested sludge, and are proven to be low maintenance and mechanically reliable. To ensure uninterrupted plant treatment operations and maintain critical processes, the District must have a readily available source of equipment, parts, and related products.
Staff confirmed that DXP Enterprises, Inc., is the authorized sole source distributor of KSB pumps, mixers, parts, and products.
Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to DXP Enterprises, Inc., for KSB pumps, mixers, parts, and products on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
The following are pertinent provisions of the agreement:
• The term of the agreement is from the date of award and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term.
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.
In accordance with NRS 332.115.1 (a) & (d), the competitive bidding process is not required because the parts, equipment and services can only be purchased from a sole source distributor and the equipment is compatible with existing equipment. DXP Enterprises, Inc., (LBE) currently holds a Clark County business license.
