BACKGROUND:

Clark County, through its Department of Public Works, is designing and constructing roadway improvements in Las Vegas Boulevard between Russell Road and Tropicana Avenue (Phase C and D). The Las Vegas Valley Water District (LVVWD) desires to replace a water pipeline and appurtenances in conjunction with the County's project. Per LVVWD's petition, the County is willing to perform the construction and construction management of the water facilities so long as LVVWD pays for all costs and expenses associated with the construction and construction management of the water facilities.

Interlocal Agreement No. 141797 provides for the responsibilities of the County and LVVWD, and also describes the terms and conditions as they relate to the County and LVVWD. The water facilities installed under this agreement will remain the exclusive property of LVVWD and will become a part of the general water distribution system. Upon completion of the project, the water facilities will be assigned to LVVWD for maintenance.

The District Attorney's Office has reviewed and approved the interlocal agreement as to form.
