BACKGROUND:
On September 05, 2023, the Board of County Commissioners approved and authorized the acquisition by negotiation a portion of Assessor's Parcel Number 140-35-601-032 (Ronald and Kathryn Angeli, husband and wife as joint tenants) needed for construction of the Orchard Detention Basin between Charleston Boulevard and Linden Avenue project. Clark County Department of Public Works staff has been engaged in negotiations; however, the negotiations have not resulted in consummating the acquisition. In the event that continued negotiations are unsuccessful, authorization to initiate a condemnation action is being requested from the Board.
Nevada Revised Statute 241.034 and the Resolution of Clark County adopted on September 5, 2006, requires the County to serve the property owners with written notice informing the property owners that the County will be considering acquiring the property by eminent domain. Such notice was mailed in a timely manner prior to the submission of this item to the Board of County Commissioners.
