BACKGROUND:
On December 21, 2021, the Board of County Commissioners (Board) approved the award of Bid No. 605975-21 for Annual Requirements Contract for Electric Service Pedestals and Replacement Components to Consolidated Electrical Distributors, Inc. dba Sun Valley Electric Supply (NBE) in the amount of $2,018,358.37 for the purchase of electric service pedestals used by Public Works.
This Contract is for the purchase of electric service pedestals used by Public Works.
The following are the pertinent provisions of the Contract:
• The term of the Contract was from date of award through August 31, 2022, and included the option to renew for 4, one-year periods and included a 120-day extension.
• Included the option to increase the award amount up to 20% based on possible increased user requirements for the renewal terms and approved budget appropriations.
• Included the option to increase the award amount up to 3% for possible price increases for renewal terms.
• Included the County’s option to terminate for cause, convenience or default and suspend the Contract with advanced written notice.
On October 19, 2023, Purchase Order 4700034029 was issued to Consolidated Electrical Distributors, Inc. dba Sun Valley Electric Supply. On May 23, 2024, Cause and Corrective Action Notice was sent to Consolidated Electrical Distributors, Inc. dba Sun Valley Electric Supply for failure to deliver. Consolidated Electrical Distributors, Inc. dba Sun Valley Electric Supply did not respond, and items were never received.
On June 26, 2024, the Purchasing and Contracts Division issued a Notice of Intent to Terminate Contract for Cause and Notice of Meeting to Consider Administrative Action, by certified letter giving the minimum 21 working days’ notice. This letter stipulated that the Contract would be terminated effective August 6, 2024, subject to the Board's approval. Staff recommends that the Board terminate the Contract with Consolidated Electrical Distributors, Inc. dba Sun Valley Electric Supply.
This action is in accordance with Page No. II-5, Section No. 34, Termination for Cause.
