BACKGROUND:
On September 2, 2025, the Board approved the selection of, and authorized the General Manager to negotiate an agreement with, Brown and Caldwell for the Clark County Area-Wide Water Quality Management Plan ("WQMP"). Under the agreement, Brown and Caldwell is to provide services that include the development of a new streamlined WQMP, coordinate public outreach efforts and comment summary, finalize the WQMP based on responses to comments, and assist with obtaining the required approvals.
Negotiations are complete, and staff is requesting authorization to execute a consulting services agreement with Brown and Caldwell.
The following are pertinent provisions of the contract:
• The initial term of the contract is from date of award until September 30, 2027;
• The contract includes the option to renew for three (3) additional one-year periods;
• The contract includes the option to terminate or suspend for cause or convenience with advance written notice.
In accordance with NRS 332.115(1)(b), the competitive bidding process is not required as the services to be performed are professional in nature, but pursuant to internal procedures, the District solicited these services through a competitive request for proposal process. Brown and Caldwell currently holds a Clark County business license.
This agenda item has been reviewed and approved by the District General Counsel.
