BACKGROUND:

The Clark County Regional Flood Control District (RFCD) has programmed funds for the design and construction of flood control improvements. On November 18, 2021, RFCD and Clark County entered into an interlocal contract for the Blue Diamond Wash between Arville Street and Interstate 15 (I-15) project. The Board of County Commissioners approved the interlocal contract on December 7, 2021.

RFCD and the County previously approved Supplemental No. 1 to the interlocal contract to increase total funds for construction and construction management for the project.

The attached Supplemental No. 2 to the interlocal contract will increase construction funding to cover the costs related to utility conflicts. The time of performance remains effective until June 30, 2026, unless time extensions are granted.

RFCD approved the second supplemental contract at its meeting on July 13, 2023.

The District Attorney's Office has reviewed and approved the second supplemental contract as to form.
