Authorization to provide 401(a) retirement plan

BACKGROUND:

Effective July 1, 2023, Clark County, Nevada (the “County”) entered into a Master Services Agreement (the “Agreement”) with Empower Retirement LLC (“Empower”) for the provision of a Deferred Compensation 457 Plan to qualified employees.  The Clark County Water Reclamation District (“District”) is a Participating Sponsor under the Agreement, allowing the District to provide a Deferred Compensation 457 Plan to its employees through the facilitation and administration of Empower.  The County also provides a 401(a) retirement plan to qualified employees through the Agreement.

Effective February 20, 2024, the District General Manager entered into a 3-year employment agreement, which included the provision of a matching deferred compensation program (the “401(a) Plan”).  The Boards’ approval and authorization will allow for Empower to facilitate and administer the 401(a) Plan for the District as to the District’s General Manager, and will authorize the District’s General Manager to execute all associated agreements or other instruments that are necessary for the 401(a) retirement plan to be utilized.

This agenda item has been reviewed and approved by the District General Counsel.
