BACKGROUND: 

Clark County was initially brought into this action as via Third-Party Complaint by one of its former contractors, Equine Events Management, LLC, which was sued in conjunction with an incident that occurred at Horseman's Park on or around October 26, 2021.  Clark County was not named as a Defendant in the underlying action.

On or around July 1, 2025, nearly two years after the statute of limitations had run, Plaintiff moved for leave to amend his complaint to add Clark County and have the amended complaint relate back to the original filing. The Court granted this order based on Clark County's notice of the subject incident--despite the fact that there was no identity of interest between Clark County and its contractor and the other factors for when a complaint should relate back were not met.  Accordingly, the Clark County District Attorney's Office hereby requests authority to file a Petition for Writ of Mandamus with the Supreme Court of Nevada compelling the Eighth Judicial District Court to deny Plaintiff's Motion for Leave to File an Amended Complaint adding Clark County as a Defendant which relates back to the original.
