BACKGROUND: 

Pursuant to NRS 445B.275, the Air Pollution Control (APC) Hearing Board must consist of seven members who are not employees of the State or any political subdivision of the State. One member must be a licensed attorney, another must be a licensed professional engineer, and a third must be a building contractor. The other four are lay member positions that do not require a professional license. The positions are voluntary, with no compensation, and the term of each appointment is three years.

The APC Hearing Board's licensed professional engineer member (Tom Foster) resigned from his position on July 21, 2021. The Department of Environment and Sustainability, Division of Air Quality has received an application from Daniel Bartlett seeking appointment to the position. Upon review of the application and after conducting an interview, staff recommends the appointment of Mr. Bartlett as the licensed professional engineer member for a three-year term, commencing on April 4, 2023, and continuing through April 3, 2026, based on his qualifications and experience with decision-making, air quality regulations, engineering, law, public administration, and administrative boards.
