BACKGROUND: 

At the May 16, 2023, Board meeting, Chair Gibson requested that the County Manager's Office review the Clark County Board of Commissioners Rules of Procedure Handbook (Rules of Procedure) in order to strengthen the Board's governing principles. In addition, Chair Gibson requested that the County Manager's Office review ethical processes and procedures to ensure transparency throughout Clark County.

Article IX of the Rules of Procedure provides that amendments to the Rules of Procedure may be proposed at any regular meeting and voted upon at any succeeding meeting, provided that at least a majority affirmative votes of the membership shall be required for adoption of such amendment.

Following the direction in May 2023, staff reviewed the Rules of Procedure and identified several provisions to be updated. In addition, staff is proposing that the Board adopt a code of conduct and a censure procedure.

The adoption of a code of conduct for the Board would help promote and maintain the highest levels of public confidence in Clark County government. In addition, a censure procedure would allow the Board to investigate one of its members if he/she/they violated a provision of the Rules of Procedure or Chapter 2.42 of the Clark County Code. In doing so, the Board would have the authority to issue a nonbinding resolution to censure one of its members for such violations. 

The Board is asked to discuss the proposed updates to the Rules of Procedure and provide guidance to staff on any additional updates needed. If directed, staff will bring a final draft of the Rules of Procedure for adoption at the December 5, 2023, Board meeting.
