BACKGROUND:
On June 4, 2024, the Board directed Staff to prepare an ordinance to amend the Clark County Code, in a manner consistent with existing State law and ordinances adopted by neighboring jurisdictions, to discourage the theft of scrap metal from public and private facilities.
This bill will adopt prohibitions and limitations regarding the purchase of scrap metal, including seven-strand copper wire commonly used in municipal or utility operations. The additional requirements regarding documentation and payment are intended to discourage illegal activity and facilitate enforcement, while helping to preserve and protect facilities that rely on copper wire.
A violation of the ordinance is a misdemeanor offense. In lieu of a criminal penalty, the ordinance permits the Department of Business License to take administrative action against any business which violates any provision of the ordinance.
The proposed ordinance was introduced on October 15, 2024. A Business Impact Statement was thereafter completed in accordance with state law and approved by the Board on November 5, 2024.
