BACKGROUND:
Pursuant to NRS 445B.500(3), civil penalty money collected for violations of the Air Quality Regulations in excess of $17,500 must be transferred to the Clark County School District (CCSD). CCSD may spend air quality penalty money only in accordance with an annual spending plan approved by the Board of County Commissioners. NRS 445B.500(3) specifies that the annual plan shall be approved if the expenditures are reasonable and limited to programs of education on topics related to air quality and projects that improve air quality.
As of June 30, 2025, Clark County has $1,059,501.98 available to transfer for CCSD’s use.
The proposed expenditure of penalty funds for fiscal year 2026 in the amount of $1,268,475.82 reflects both the $1,059,501.98 available for transfer and the $208,973.84 balance carried over from fiscal year 2025. The proposed expenditure includes continuation of support for the Pollen Monitoring and Education Program conducted by CCSD and the University of Nevada, Las Vegas; continuation of support for the Las Vegas Science and Technology Festival; science and technology professional development for teachers and staff; development and/or review of Science, Technology, Engineering and Mathematics curriculum, resources, and learning lessons regarding clean air, ozone awareness, and health and safety issues related to air quality; acquisition of instructional materials that are aligned with the revised Nevada Academic Content Standards for Science and Mathematics to support Problem-Based Learning instruction related to topics related to air quality in Clark County; and evaluation of the feasibility and implementation of energy efficiency and air quality improvement projects within CCSD in partnership with the Clark County Department of Environment and Sustainability, including, but not limited to, implementation of a Heating, Ventilation and Air Conditioning System and Indoor Air Quality Sensors Program for CCSD's schools and a pilot air purification systems program in classrooms to improve indoor air quality. The proposed expenditure also includes the ability for CCSD to be flexible in spending allocated funding between air quality improvement projects and instructional categories.
