BACKGROUND:
Since 1983 the Clark County Water Reclamation District Board of Trustees (Board) has delegated specific authorities to the General Manager, which included but is not limited to, purchasing of goods and services, sale of property, advertising for bids, approving interlocal agreements, approving work modifications, records retention, renewal of leases, and reservation of sewer capacity.
On September 21, 2021, the Board adopted Resolution 21-004, which provided a single source of reference for authority delegated to the General Manager by the Board, titled “Authority Delegated by the Board of Trustees to the General Manager” (“GM Authority”). The GM Authority instrument clarified outdated resolutions, filled identified gaps in authority needed to effectively manage District daily operations, and provided for a single source document for easier reference and administration of General Manager authority delegated by the Board. On October 4, 2022, the Board adopted Resolution 22-003, which included some clarifications and adjustments to the GM Authority.
Since that time, updates to the form interlocal agreement and acknowledgement at Appendix C and Appendix D of the GM Authority have been negotiated with the City of Henderson and City of North Las Vegas and incorporated into the updated GM Authority attached to Resolution 23-002 as Attachment A.
Along with the specific delegated authority, the resolution vests in the General Manager all authority necessary or incidental to or implied from the specific authority granted by the resolution. If adopted, Resolution 23-002 will replace and supersede Resolution 22-003.
