Receive, discuss, and approve or deny an application from The Primadonna Company, LLC d/b/a Whiskey Pete's Hotel & Casino for a waiver of license requirements for a period of up to twenty-four months with the possibility of two additional six-month extensions during the temporary closure; authorize the Director of Business License to grant two additional six-month extensions upon additional showings of good cause if the initial application is approved; and direct staff accordingly. BACKGROUND:
Clark County Code Section 8.04.140(G) provides that if a gaming licensee does not meet the conditions and requirements of its license for a period of over thirty consecutive days, the county gaming license shall automatically suspend or be nonrenewable. The licensee may apply to the board, and upon good cause shown (i.e., remodeling, labor disputes, reasons beyond its control) for such unavailability of rooms and/or resort hotel requirements, the board may waive requirements and conditions for a period up to twenty-four months and may grant two additional six-month extensions upon an additional showing of good cause and due diligence. However, the total periods of waiver shall not exceed three calendar years as to any waiver of requirements.
The Primadonna Company, LLC, owns and operates Whiskey Pete's Hotel & Casino, located at 100 W Primm Blvd, Jean, NV 89019. Whiskey Pete's Hotel & Casino is a grandfathered location that was approved by the Nevada Gaming Control Board to install forty (40) slot machines at the Whiskey Pete's Stateline Stop (Truck Stop) on April 17, 2013, with conditions. Twenty-two (22) slot machines are currently installed. The 40 slot machines approved in 2013 were in addition to existing machines already installed in the resort casino and were to be included in the total slots reported by Whiskey Pete's Hotel & Casino under their current resort gaming licenses.
On October 18, 2024, the Clark County Director of Business License received a request for approval, from The Primadonna Company, LLC, to temporarily close the resort portion of Whiskey Pete's Hotel & Casino and continue to operate the Truck Stop during the resort closure. If the closure is approved, Whiskey Pete's Hotel & Casino would no longer meet the requirements of Clark County Code 8.04.010.145 - Resort Hotel
