Dark Fiber IRU Agreement

The total Agreement is estimated in the amount of $1,564,399.05, should all renewal options be exercised.

 

BACKGROUND: 

This Agreement is for dedicated dark fiber with Switch, LTD. (NBE).

A Fiscal Directive No. 6, Competitive Bidding Exception, was approved because of the supercomputer that the dedicated dark fiber line will be connected to sits within the vendor's infrastructure. Vendor will not allow third party access to their facility which does not allow County to use another vendor.

The following are the pertinent provisions of the Agreement:
                     The term of the Agreement is for 5 years from date of award and includes the option to renew for 2, five-                     year periods.
                     Includes the option to increase the Operating and Maintenance (O&M) Fee annually based on the                      Consumer Price Index.
                     Includes the County’s option to terminate for cause, convenience or default with advanced written notice.

The recommendation of award is in accordance with NRS 332.115.1(b), the competitive bidding process is not required as the services to be performed are professional in nature and (g), hardware and associated peripheral equipment and devices for computers.

Switch, LTD. currently holds a Clark County Business License.
