BACKGROUND:
The District's West Campus Effluent Reuse Water (ERW) Pump Station and Temporary Storage Ponds utilize Floway vertical turbine pumps, which are solely distributed by Phoenix Pumps, Inc. Floway pumps collect the effluent reuse water for use throughout the District facilities as a flush/cooling water supplied to all pump seals, which is economical, and prevents cross contamination hazard in the potable water distribution system. To ensure uninterrupted plant treatment operations and maintain water treatment critical processes, the District must have a readily available source of equipment, replacement parts, and related products.
Staff confirmed that Phoenix Pumps, Inc. is the authorized sole source distributor of Floway pumps, parts, and products.
Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Phoenix Pumps, Inc. for Floway pumps, parts, and products on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
The following are pertinent provisions of the agreement:
• The term of the agreement is from July 1, 2022 and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.
In accordance with NRS 332.115.1 (a) & (d), the competitive bidding process is not required because the parts, equipment and services can only be purchased from a sole source distributor and the equipment is compatible with existing equipment. Phoenix Pumps, Inc., (LBE) currently holds a Clark County business license.
