BACKGROUND: 

Clark County owns the Searchlight Cemetery located in Searchlight, Nevada (APN 243-35-801-003) and is responsible for this facility's care and maintenance.  This cemetery location is generally described as near the intersection of Nugget Lane and Easy Street alignments, on Cemetery Access Road.

The Searchlight Museum Guild, a non-profit organization in Nevada, entered into an agreement with Clark County in 2012 and wishes to continue to maintain the cemetery on behalf of the County at no cost to County for another three years with the ability to renew the Agreement for two additional, 3-year periods by mutual consent.  The letter of Agreement will become effective upon the date of Board of County Commissioner ratification.

The Guild will be responsible for all costs, arrangements, scheduling, contracts, and equipment related to the cemetery's maintenance as provided in the Agreement.  The Guild may provide additional improvements at no cost to the County following approval of such proposals by the directors of Parks and Recreation and Real Property Management and upon written approval by the County.

The County reserves the right to control the premises, enforce rules and regulations, and inspect the facility at any time.  If approved, the Agreement will be effective from the date of Board approval for a period of three years, unless terminated earlier by either party.

Staff recommends approval of the Agreement. The District Attorney's Office has reviewed and approved the Agreement as to form.
