BACKGROUND: 

The claim is a result of a motor vehicle accident on August 07, 2017, whereby the Clark County driver did not stop in time and rear ended the claimant's vehicle. The total property damage was at $1,724.65. Total medical treatment for Antonio Gonzalez-Rodriguez was approximately $524,568.24, however, it was discovered that many of the medical bills were associated with a subsequent worker's compensation case and updated calculations arguably attribute treatment to approximately $60,000. Total medical treatment for Consuelo Gonzalez Posada was $54,931.64.

Through negotiations with legal counsel for the claimants, the claimants have agreed to accept a settlement of $80,000 for Antonio Gonzalez-Rodriguez and $75,000 for Consuelo Gonzalez Posada in settlement of all their claims to avoid any further costs and legal expenses of possible litigation in this case. If the settlement is approved, the County would also avoid costs and expenses of any future litigation.

The proposed settlement has been reviewed and approved by the Civil Division of the District Attorney’s Office and the Clark County Liability Pool Committee members.
