BACKGROUND: 

Clark County Code Section 8.04.140(G) provides that if a gaming licensee does not meet the conditions and requirements of its license for a period of over thirty consecutive days, the county gaming license shall automatically suspend or be nonrenewable. The licensee may apply to the board, and upon good cause shown (i.e., remodeling, labor disputes, reasons beyond its control) for such unavailability of rooms and/or resort hotel requirements, the board may waive requirements and conditions for a period up to twenty-four months and may grant two additional six-month extensions upon an additional showing of good cause and due diligence. However, the total periods of waiver shall not exceed three calendar years as to any waiver of requirements.

Tropicana Las Vegas, Inc. ("TLVI"), which is an indirect subsidiary of Bally's Corporation ("Bally's"), owns and operates the Tropicana Las Vegas ("Tropicana"), located at 3801 Las Vegas Blvd. S., Las Vegas, NV 89109. On March 15, 2024, TLVI submitted a letter to the Department of Business License to announce the closure of the Tropicana resort on effective April 2, 2024, and to apply for a waiver of license conditions pursuant to Clark County Code Section 8.04.140(G) during the closure, demolition, and reconstruction of the resort.

The closure will be followed by the demolition of the existing buildings which Bally's is obligated to complete by April 1, 2025, at which time a three-year construction for a Major League Baseball Stadium is to begin. The Oakland Athletics intend to open the stadium by April 1, 2028. Bally's is also responsible for building public spaces for utilization of the stadium and parking, including a parking garage if needed by the Athletics prior to commencement of the planned resort hotel development. Bally's does not currently have an estimate of when a new resort hotel may reopen.

Staff recommends that the Board receive, discuss, and approve or deny TLVI's application for a waiver of license requirements for a period of up to twenty-four months with the possibility of two additional six-month extensions during the temporary closure, demolition, and reconstruction of the resort. If the Board approves the application, staff recommends that the waiver should be effective the day of closure on April 2, 2024, and that the Director of Business License be approved to administratively extend the waiver for two additional 6-month periods upon an additional showing of good cause and due diligence.
