BACKGROUND:
Pursuant to Nevada Revised Statute (NRS) 237.080 and 237.090, a Business Impact Statement was prepared for the proposed ordinance amending: (1) Clark County Code, Title 16, Chapter 16.06 by incorporating various provisions relating to lane closures relating to roadway special events, including definitions, application and permit processes, restrictions, fees, costs, insurance requirements, and traffic control plans; (2) Clark County Code, Title 16 by adding provisions relating to lane closures relating to right-of-way permits and traffic control plans; (3) Clark County Code, Title 30, Chapter 6, Section 11G by adding provisions relating to lane closures relating to right-of-way permits and traffic control plans; (4) Clark County’s Title 30 Fee Schedule by updating various fee amounts relating to Title 30 applications and administrative fees relating to right-of-way permits, and adding additional fees relating to right-of-way permits; and (5) Clark County’s Off-Site Improvement Bond Estimate Tabulation form by updating various fee amounts and adding additional fees.
On August 28, 2025, the Clark County Department of Public Works (CCPW) sent its proposed amendments to various chambers of commerce, trade associations, developers, contractors, and entities totaling over 600 notifications. The notification and proposed ordinance were also available on the CCPW website. Per NRS 237.080, following a comment period that lasted fifteen (15) working days, twelve (12) written comments were received.
On December 10, 2025, pursuant to NRS 237.080(5), CCPW held a workshop to respond to comments or concerns regarding the proposed ordinance. At the workshop, there were comments from approximately thirteen (13) stakeholders regarding the changes to Title 16 opposing intersection closing fees, lane occupancy fees, and the impact of these fees. There were comments from approximately six (6) stakeholders regarding Title 30 fee changes regarding impact on the industry.
On July 8, 2026, Public Works held an Informational Meeting to discuss revisions to the Proposed Amendments. On August 12, 2026, Public Works held a working group meeting with Stakeholders to discuss the Proposed Amendments, as requested by attendees of the July 8, 2026, Informational Meeting. On August 25, 2026, Public Works held a working group meeting to finalize the revisions to the Proposed Amendments.
Comments about Title 16 and Title 30 expressed concerns about impact these fees may have for home affordability and the financial burden on smaller businesses in the development space. In response and based on feedback from industry stakeholders both at the workshop and written, CCPW modified the original proposed lane occupancy fee and modified inspection fees listed on the Off-Site Improvement Bond Estimate Tabulation Form. The $50 lane occupancy charge, per calendar day, or a portion of a calendar day for each leg segment of 660 feet or less in length that a lane is closed for an offsite improvement permit and encroachment permit, and $100 charge per day, per lane that reduces the lane through a signalized intersection was replaced with the current City of Henderson right-of-way occupancy charge. Calculation of the fees for a right-of-way occupancy charge shall commence on the first day following the effective date of the barricade permit fee for the lane closure for a roadway special event. The fee shall be $50 per day for each lane that is closed at any time of the day.
Staff recommends that the Board consider and approve the attached business impact statement and determine that it does not impose a significant economic burden upon business nor restrict the formation, operation, and expansion of businesses.
