BACKGROUND:
During the 2023 legislative session, the legislature adopted Senate Bill 92, which set forth various requirements for the licensing and regulation of sidewalk vendors of food. Section 7.5 of the Bill prohibits sidewalk vending within 1,500 feet of certain areas, subject to specific exceptions. The Bill further states that a County that does not adopt an ordinance that substantially complies with the requirements of the Bill, shall not cite, fine or prosecute a sidewalk vendor for a violation.
This proposed ordinance adds a new chapter to the Clark County Code, designated as Chapter 18.03 "Prohibition of Sidewalk Vending," that substantially complies with the provisions in Senate Bill 92. The provisions in Chapter 18.03 will enable the County to enforce the 1,500 feet distance restrictions set forth in Senate Bill 92.
The proposed ordinance was introduced at the September 19, 2023, Board of County Commissioners' meeting, and a public hearing was scheduled for October 3, 2023, at 10:00 a.m. Staff recommends approval of the ordinance to amend Title 18 of the Clark County Code.
