BACKGROUND:

On October 10, 2013, the Regional Flood Control District (RFCD) approved an interlocal contract to fund the construction of the Las Vegas Wash - Sloan Channel to Bonanza Road and Flamingo Wash below Nellis Boulevard project. This project included improvements to increase the storm carrying capacity of a section of the Las Vegas Wash and a section of the Flamingo Wash through the Desert Rose Golf Course, now known as the Club at Sunrise Golf Course. A maintenance and operation plan was developed by Clark County's consultant to define the maintenance responsibilities of Clark County Public Works (CCPW) and Clark County Parks and Recreation (CCP&R) regarding the channels through the golf course and the golf course itself.

Annually, RFCD establishes a budget for the maintenance and operations of completed flood control facilities. The Interlocal Agreement approved by RFCD on November 8, 2018, established an equitable funding mechanism for routine maintenance of the channels through the Club at Sunrise Golf Course utilizing the funds allocated in the separate annual operations and maintenance interlocal agreement with Clark County. The Board of County Commissioners approved the interlocal agreement on December 4, 2018.

The attached first amendment extends the project completion date to November 7, 2033, continuing to set forth the responsibilities of RFCD and Clark County to maintain the Las Vegas Wash and the Flamingo Wash through the Club at Sunrise Golf Course.

RFCD approved the first amendment at its meeting on December 14, 2023.

The District Attorney's Office has reviewed and approved the first amendment as to form.
