BACKGROUND:
NRS 4.150 authorizes the Clark County Board of Commissioners ("Board") to appoint an individual to fill a vacancy that occurs in the office of Justice of the Peace. NRS 245.170 establishes the process by which the Board may make such an appointment, requiring, when permitted, the appointment of a suitable person who is an elector of Clark County to serve the remainder of the unexpired term. Pursuant to that statutory authority, on June 16, 1015, the Board adopted a resolution creating a Justice of the Peace Nominating Committee to Recommend Qualified Nominees to the Board for Appointment to Vacant Justice of the Peace Offices.
The amended and restated resolution permits the Board to waive the appointment of a Nominating Committee, or any procedures set forth in the resolution, and appoint a qualified person to fill the vacancy by an alternate process.
