BACKGROUND: 

The District has existing sanitary sewer assets located within the Tropicana Avenue, Dean Martin Drive, and Harmon Avenue right-of-way(s), which includes manholes and pipelines for wastewater conveyance to the Flamingo Water Resource Center. NDOT has scheduled Project SPI-015-1(085), for the construction of Route I-15 at Tropicana Avenue interchange, grade separation on Tropicana Avenue and Dean Martin Drive, and HOV ramps at Harmon Avenue from MP CL 34.847 to MP CL 40.551. During a roadway construction project, manholes are required to be adjusted prior to the installation of new paving, after which the manholes are then raised to the new elevated grade.

Pursuant to the District’s Right-of-Way Occupancy Permits, NRS 408.210 and 408.423, the District is required to pay for sanitary sewer manhole adjustments where NDOT has acquired prior rights to the right-of-way. The Manhole and Valve Cover Agreement Letter provides that NDOT's contractor will perform the manhole adjustments and then the District will pay for the associated costs, estimated to be five thousand dollars ($5,000.00) per manhole, plus an additional fee of between five percent (5%) and fifteen percent (15%) of the manhole costs for construction engineering and administration. Four (4) non-compensable manholes have been identified as needing adjustment within the NDOT project, with a twenty percent (20%) contingency for additional manholes (identified as part of Project SPI-015-01(085) after the date hereof) and/or volatile construction costs, which results in a total not-to-exceed cost of twenty-seven thousand six hundred dollars ($27,600).

Staff recommends that the Board approve and authorize the General Manager to sign the Manhole and Valve Cover Agreement Letter between NDOT and the District for sanitary sewer manhole adjustments.
