BACKGROUND: 

Clark County Code Section 8.04.140(G) provides that if a gaming licensee does not meet the conditions and requirements of its license for a period of over thirty consecutive days, the county gaming license shall automatically suspend or be nonrenewable. The licensee may apply to the board, and upon good cause shown (i.e., remodeling, labor disputes, reasons beyond its control) for such unavailability of rooms and/or resort hotel requirements, the board may waive requirements and conditions for a period up to twenty-four months and may grant two additional six-month extensions upon an additional showing of good cause and due diligence. However, the total periods of waiver shall not exceed three calendar years as to any waiver of requirements.

On July 2, 2025, The Primadonna Company, LLC, d.b.a. Buffalo Bill's Resort & Casino (Buffalo Bill's) , located at 31700 Las Vegas Blvd S., Jean, NV 89019, submitted a request to the Department of Business License to announce the temporary closure of Buffalo Bill's effective July 14, 2025 (60-day approval granted from the Director of Business License), and to apply for a waiver of license conditions pursuant to Clark County Code Section 8.04.140(G) during the temporary closure.

On August 8, 2025, Buffalo Bill's sent an updated request for temporary closure. In the updated request they stated that the request for temporary closure is due to the slowing of post-pandemic traffic at Stateline, which has moved a great majority of their business to weekend activity only.

During the temporary closure, Buffalo Bill's also requests approval to open periodically eight (8) to ten (10) times per year, which would meet the Nevada Gaming Control Board's (NGCB) requirement that Buffalo Bill's opens at least once every quarter for at least 8 hours. The periodic openings will be for concerts and special events. NGCB's temporary closure is approved through June 29, 2027, with the option to request an extension of the temporary closure, if necessary.

Staff recommends that the Board receive, discuss, and approve or deny Buffalo Bill's application for a waiver of license requirements for a period of up to twenty-four months with the possibility of two additional six-month extensions during the temporary closure, and periodic operation of the resort during those times. If the Board approves the application, staff recommends that the waiver should be effective on the date of closure, July 14, 2025, and that the Director of Business License be approved to administratively extend the waiver for two additional 6-month periods upon an additional showing of good cause and due diligence.
