BACKGROUND: 

On March 3, 2020, the Board of County Commissioners ("Board") approved a Revocable License Agreement with LV Stadium Events Company, LLC, a Nevada limited liability company and subsidiary of the Las Vegas Raiders football team ("StadCo"), to utilize 20 acres of the 100-acre Tropicana Detention Basin ("Basin") for employee parking on the days events are held at Allegiant Stadium. StadCo would be responsible for all parking related improvements ("Stadium Facilities") and for the staffing and operations of the parking lot on event days. In consideration for the right to use the Basin for up to 34 days during the one year term, StadCo would pay an annual license fee. Additional fees were also required if StadCo exceeded the 34 day limit.

On March 2, 2021, the Board approved a new Revocable License Agreement ("StadCo License") to replace the expired agreement for an additional term of one year, which included a 3% increase to the license fee. On November 2, 2021, the Board approved the First Amendment to Revocable License and Maintenance Agreement, which extended the term of the StadCo License to five years, included an annual 3% increase to the license fee and added a deadline for completion of the pavement improvements. The StadCo License expires on March 26, 2026 and the licence fee is $94,846.68.

The Las Vegas Super Bowl Committee, Inc., a Nevada nonprofit corporation ("LVSBHC"), contacted the County to request the use of a portion of the Basin, including the Stadium Facilities, for off-site operational compounds and vehicle and cargo inspection screening for Super Bowl LVIII being held at Allegiant Stadium on February 11, 2024. On October 31, 2023, StadCo provided a letter to the County stating its acknowledgement and support of LVSBHC's request to utilize the property with the understanding access would begin as early as January 8, 2024 and conclude no later than February 29, 2024.

Staff has reviewed this request and is supportive of the secondary use of the Basin, including Stadium Facilities, by LVSBHC for the build out of Allegiant Stadium for Super Bowl LVIII and other operations related thereto. The attached Revocable License Agreement ("LVSBHC License") for the Board's consideration establishes the right for LVSBHC to access and use the Basin, including the Stadium Facilities, and the payment of a license fee to the County totaling $15,807.78. The term of the LVSBHC License is from January 1, 2024 to February 29, 2024. The license fee being charged to LVSBHC is at the same rate as the StadCo License.
