BACKGROUND:

On February 7, 2023, the Board of County Commissioners approved and authorized the acquisition by eminent domain a portion of Assessor's Parcel Number 162-23-310-007 (Centennial Commerce, LLC, a Nevada limited liability company) needed as right-of-way for the improvements to the Harmon Avenue between Maryland Parkway and Boulder Highway project. An appraisal prepared for the County reflected an amount of $65,812, however, the property owners rejected the offer. Upon extensive negotiations between the District Attorney's Office and the opposing counsel, a proposed settlement has been reached in the amount of $80,000.

Authorization to approve and authorize the proposed settlement is now being sought from the Board.
