BACKGROUND:
The claim is a result of an accident that occurred at Horseman's Park motor vehicle accident on or around October 26, 2021, whereby a delivery driver was injured when horse gates fell from his truck striking him in the head. The driver contended the accident was the result of the negligence of a Clark County employee who was assisting with the unloading. The total bills for medical treatment alleged was $568,886.16.Through review of the claims and evidence in litigation, the Clark County District Attorney's Office - Civil Division determined that $33,333.34, as part of a global offer with parties that owe Clark County contractual indemnity, would be a reasonable settlement for the claims alleged due to disputed liability and the costs of maintaining a defense through trial. The settlement has been reviewed and approved by the Liability Insurance Pool.
